1. How can one apply for Attestation of Will ?

Depending on if you are (Indian Passport Holder OR USA Passport and OCI Holder OR USA Passport Holder),

Please go through the checklist which is applicable to you, and bring the Application with Supporting documents to the Consulate between 10:00 AM to 12:00 PM

2. Does one need to make an appointment for Attestation of Will ?

Applicants may walk into the Consulate on any working day as per below:
Timing for submitting the documents: 10:00 AM to 12:00 PM.
Timing for collection of the documents:Next day 10:00 AM - 12:00 PM

3. What is the processing time for Attestation of Will ?

One day (Next Day), for the application submitted in Person/over the counter.

4. Documents  valid as a proof of address/residence?

•    US Driving License OR

•    Utility Bill OR

•    Lease Agreement OR

•    State Identity Card OR

•    Mortgage Deed

5. What Documents are valid as a proof of US Visa Status?

•    Visa page of Passport (i.e. H1B, H4, L1, L2 etc.) OR

•    Green Card. OR

•    Employment Authorization Document (Work Permit) OR

•    I-797, I-140 or I-20

6. Can Applicants send the documents to the Consulate by Post or Physical Mail ?

  • The applicant’s signature on the Will should match the signature on the applicant’s current passport.

  • A recent passport-size color photograph of the applicant must be affixed to the Will.

  • Two witnesses must sign the Will in the presence of a Notary (The witnesses do not need to be present at the VFS Global Application Centre or the Consulate)

Note: Witnesses cannot be the applicant’s spouse or blood relatives.

4.

Notarized copy of the current passport (first and last pages)

5.

Notarized copy of proof of U.S. legal status showing a valid U.S. visa

Notarized copy of proof of address in the U.S.

  • Two witnesses must sign the Will (The witnesses do not need to be present at the VFS Global Application Centre or the Consulate)

FAQs on Attestation of Will

Stage 1 – Submission

Follow the 2 steps mentioned above to submit the required documents to VFS Global (either in person or by mail).

Stage 2 – VFS Review

VFS Global reviews the documents. If the application is complete, VFS forwards the file to the Consulate.

(Note: If any documents are missing, VFS Global will notify the applicant by email. The applicant must submit the requested documents within 21 business days. Failure to do so will result in rejection of the application.)

Stage 3 – Consulate Processing

The Consulate verifies the application, processes it, and returns it to VFS Global.

Stage 4 – Closure

VFS Global closes the application and dispatches the processed documents to the applicant.
